Data collection on the website

First of all, we would like to inform you that we only collect personal data when you contact us, for example by e-mail or the contact form in our newsletter (see below paragraph nhb newsletter). The data processing is not based on automated decision making. No profiling takes place. The legal basis for the collection of personal data is Art. 6 para. 1 lit a) and Art. 6 para. 1 lit f.  During your visit to our website, the following data is collected while using the website (“usage data”):

– the requested page

– Date, time and duration of your visit

– Your Internet provider

– Name and version of your internet browser and

– Your operating system.

This usage data is only collected by us for internal, statistical purposes (how many visitors per day, which pages are of particular interest) and to improve our website offering and is anonymized. We do not draw any conclusions about the identity of the user on the basis of the usage data. No personal profiles are created; social plugins (Twitter, Google, Facebook, etc.) are not used by us.

Your personal data (name, e-mail address, company) will only be collected, stored or otherwise processed if you provide it to us via our contact form or by e-mail. Which personal data is transmitted to us in the process is indicated in the input mask of the contact form or in your e-mail to us. Your data will be used exclusively within the company (for the creation of interest-related distribution lists, for example for invitations to events) and for communication with you. We delete the personal data collected and processed in this context after storage is no longer required for this purpose, or restrict processing if there are legal retention obligations. For internal surveys, nhb uses Google Analytics, a web analytics service provided by Google Inc. (1600 Amphitheatre Parkway Mountain View, CA 94043, USA). So-called “cookies” are used for this purpose. These are small text files that are (temporarily) stored on your device. These give us information about your visit to our website. By means of a cookie, the information and offers on our website can be optimized in terms of the user. Cookies allow us, as already mentioned, to recognize the users of our website. The purpose of this recognition is to make it easier for users to use our website and to make it more user-friendly. The information generated by the cookies is transmitted on our behalf to a server of Google Inc. in the USA and stored there. nhb uses Google Analytics with the extension “_anonymizeIp()” . Your IP address is thereby shortened and not transmitted in full (“anonymized”). A transmission of personal data to Google Inc. thus does not take place.

Google will use the transmitted information for the purpose of evaluating your use of the website, compiling reports on website activity for nhb and providing other services relating to website activity and internet usage. Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google’s behalf. Google will not associate or merge your IP address with any other data held by Google. The legal basis for the use of Google Analytics is Art. 6 (1) lit. f DSGVO. Only expert employees have access to our website and IT systems. Our servers are hosted exclusively in the Federal Republic of Germany and all data is protected with appropriate measures against third-party access, destruction, modification or distribution by unauthorized persons.

nhb newsletter and new privacy policy

With the following information, we inform you about the contents of our newsletter as well as the registration, dispatch and statistical evaluation procedure and your rights of objection. By subscribing to our newsletter, you agree to receive it and to the described procedures.

Newsletter content

We send newsletters, e-mails and other electronic notifications with promotional information (hereinafter “newsletter”) only with the consent of the recipients or a legal permission. Insofar as the contents of the Newsletter are specifically described in the context of a registration, they are decisive for the consent of the users.

Double opt-in and logging

The registration for our newsletter takes place in a so-called double opt-in process. This means that after registration you will receive an e-mail in which you are asked to confirm your registration. This confirmation is necessary so that no one can register with other email addresses.

The registrations for the newsletter are logged in order to be able to prove the registration process according to the legal requirements. This includes the storage of the registration and confirmation time, as well as the IP address. Likewise, the changes to your data stored with MailChimp are logged.

Use of the shipping service provider “MailChimp

The newsletter is sent using “MailChimp”, a newsletter sending platform of the US provider Rocket Science Group, LLC, 675 Ponce De Leon Ave NE #5000, Atlanta, GA 30308, USA.

The email addresses of our newsletter recipients, as well as their other data described in the context of these notes, are stored on the servers of MailChimp in the USA. MailChimp uses this information to send and evaluate the newsletter on our behalf. Furthermore, according to its own information, MailChimp may use this data to optimize or improve its own services, e.g. to technically optimize the dispatch and display of the newsletters or for economic purposes to determine from which countries the recipients come. However, MailChimp does not use the data of our newsletter recipients to write to them itself or to pass them on to third parties.

We trust in the reliability and IT and data security of MailChimp. MailChimp is certified under the US-EU data protection agreement “Privacy Shield” and thus undertakes to comply with the EU data protection regulations. Furthermore, we have concluded a “Data Processing Agreement” with MailChimp. This is a contract in which MailChimp undertakes to protect the data of our users, to process it on our behalf in accordance with its data protection provisions and, in particular, not to pass it on to third parties. Login data

To subscribe to the newsletter, it is sufficient to provide your email address. Optionally, we ask you to provide your first and last name. This information is only used to personalize the newsletter.

Statistical survey and analyses

The newsletters contain a so-called “web beacon”, i.e. a pixel-sized file that is retrieved from the MailChimp server when the newsletter is opened. As part of this retrieval, technical information, such as information about the browser and your system, as well as your IP address and time of retrieval are collected. This information is used for the technical improvement of the services based on the technical data or the target groups and their reading behavior based on their retrieval locations (which can be determined with the help of the IP address) or the access times.

The statistical surveys also include determining whether the newsletters are opened, when they are opened and which links are clicked. For technical reasons, this information can be assigned to individual newsletter recipients. However, it is neither our endeavor nor that of MailChimp to observe individual users. The evaluations serve us much more to recognize the reading habits of our users and to adapt our content to them or to send different content according to the interests of our users.

Online call and data management

There are cases where we direct newsletter recipients to MailChimp’s websites. E.g. our newsletters contain a link with which the newsletter recipients can retrieve the newsletters online (e.g. in case of display problems in the email program). Furthermore, newsletter recipients can subsequently correct their data, such as the e-mail address. Likewise, the privacy policy of MailChimp is only available on their site.

In this context, we would like to point out that cookies are used on the websites of MailChimp and thus personal data is processed by MailChimp, its partners and service providers used (e.g. Google Analytics). We have no influence on this data collection. You can find more information in the privacy policy of MailChimp. We would also like to draw your attention to the options for objecting to the collection of data for advertising purposes on the websites http://www.aboutads.info/choices/ and http://www.youronlinechoices.com/ (for the European region).

Termination/Revocation

You can cancel the receipt of our newsletter at any time, i.e. revoke your consents. With this, your consents to its dispatch via MailChimp and the statistical analyses expire at the same time. A separate revocation of the dispatch via MailChimp or the statistical analysis is unfortunately not possible. You will find a link to cancel the newsletter at the end of each newsletter.

Legal basis Data Protection Regulation

In accordance with the requirements of the Basic Data Protection Regulation (DSGVO) applicable as of May 25, 2018, we inform you that the consent to the sending of email addresses is based on Art. 6 para. 1 lit. a, 7 DSGVO as well as § 7 para. 2 No. 3, or para. 3 UWG. The use of the dispatch service provider MailChimp, implementation of statistical surveys and analyses as well as logging of the registration process, are carried out on the basis of our legitimate interests pursuant to Art. 6 para. 1 lit. f DSGVO. Our interest is focused on the use of a user-friendly and secure newsletter system that serves our business interests and meets the expectations of users.

We would also like to point out that you can object to the future processing of your personal data in accordance with the legal requirements pursuant to Art. 21DSGVO at any time. The objection can be made in particular against the processing for purposes of direct marketing.
